Claude and Claire Dubois appeal from a summary judgment entered in the Superior Court (York County, Brennan, J.) on their action against the City of Saco following the City’s foreclosure of a tax lien on real property owned by them located on Buxton Road. The Duboises contend that the trial court erred in determining that the penalty imposed by the City pursuant to the Tree Growth Tax Law, 36 M.R.S.A. §§ 571 to 584-A (1990 & Supp.1993), became a tax lien on their property and that they were precluded from challenging the propriety of the City’s decision to remove the…
