— Order unanimously modified and, as modified, affirmed, without costs, and matter remitted to the arbitrator for further proceedings, in accordance with the following memorandum: A collective bargaining agreement entered into between the parties, effective September 1, 1975 and for three years thereafter, provided for compensation to be paid to car and truck salespersons employed by petitioner Heinrich Motors, Inc., part of which related to a percentage of the gross profit realized by petitioner on. each unit of sale.
