This suit was brought by a certified teacher seeking damages for denial of a position as tutor-counselor under a federal grant, and mandatory reinstatement to that position.

Central Valley School District had, at the time of this suit, approximately 11,000 students, of which 175 were of Indian descent. In 1977 the school district applied for and was awarded a grant under the Indian Education Act, 20 U.S.C. § 241aa-ff (Supp. 1972).
