Hines, Director General of Rail roads, under federal control, and substituting Jas. 0. Davis for John Barton Payne after bis appointment as Agent; appellee alleging that tbe above-named bad possession and control of tbe lines of railway of tbe Gulf, Colorado & Santa Fé Railway.
