This appeal comes from the district court of Nueces county, where it was tried upon change of venue from Hidalgo county. Appellee, the Mercedes Plantation Company, sued the appellant, the American Rio Grande Land Irrigation Company, both domestic corporations, for damages arising from alleged breach of contract by appellant to furnish water to appellee for irrigation purposes.
