MEMORANDUM ORDER
RICHARD W. ROBERTS, District Judge.
On May 15, 2009, the parties filed a joint stipulation to dismiss this action with prejudice under an agreement reached between them. An order was issued that same day dismissing this case with prejudice and vacating the preliminary injunction issued on December 13, 2006.
