Richard A. Burton sued his former employer, Arkansas Secretary of State Mark Martin (“Secretary of State”), in his official capacity, and the Chief of the Arkansas State Capitol Police, Darrell Hedden, in his individual and official capacity, (collectively, “state defendants”) for race discrimination and retaliation under Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e, et seq.; 42 U.S.C. § 1988; and the Equal Protection Clause of the Fourteenth Amendment.
