ANN CRAWFORD McCLURE, Justice.

James Lee Sweed brings this restricted appeal complaining of the trial court’s dismissal for want of prosecution. For the reasons that follow, we reverse and remand.

FACTUAL AND PROCEDURAL BACKGROUND

On August 12, 2005, Sweed filed suit against James L. Nye, District Attorney Jaime Esparza, the Office of the District Attorney, the State of Texas, and the Texas Attorney General alleging claims for malicious prosecution and false imprisonment.
