HENLEY, District Judge.

This is an action brought by the Secretary of Labor under the authority of section 17 of the Fair Labor Standards Act of 1938, as amended by the Act of May 5, 1961, Pub.L. 87-30, 75 Stat. 74, 29 U.S.C.A. (Cum.Supp.), § 217. The Secretary contends that the defendants have been in violation of the overtime compensation provisions of the Act, 1 and that unless an injunction is issued the alleged violations will continue.
