This is an interlocutory appeal from an order of a District Court judge denying the defendant’s motion to suppress evidence. A single justice of this court allowed the defendant’s application for interlocutory appeal and referred the matter to the Appeals Court. The Appeals Court concluded that the mo*605tion to suppress should have been allowed. Commonwealth v. Blevines, 54 Mass. App. Ct. 89 (2002). We granted the Commonwealth’s application for further appellate review and reverse the order of the District Court.1
