McEWEN, P.J.E.:

¶ 1 Appellants, Robert and John Florig, appeal from the order of the trial court denying their petition to open the judgment of non pros that had been entered against them. We reverse in part and affirm in part.

¶ 2 The litigation that has culminated in this appeal commenced on December 18, 1996, when appellants, who were owners of a parcel of property located in Montgomery County, filed a complaint in trespass against the following parties: the estate of William J.
