GOURLEY, District Judge.
Action was filed in this court for damages arising out of an automobile accident which occurred at Erie, Pennsylvania.
*8Plaintiff is a citizen and resident of the state of New York, and defendant is a. citizen and resident in this district. The matter in controversy exceeds the amount of $3,000. Jurisdiction therefore exists. 28 U.S.C.A. § 41, Para. 1, now 28 U.S.C.A. Section 1332(a)(1).
