MOLLOY, Judge.

The defendant appeals from convictions of burglary and grand theft; he contends the trial court committed fundamental error in instructing the jury.

The evidence, stated favorably to upholding the verdicts rendered below, State v. George, 95 Ariz. 366, 390 P.2d 899 (1964), indicates the defendant and his wife were guests in the home of the alleged victim on the evening before the alleged burglary.
