The single question presented herein is whether or not the bonding company is liable for the purchase price of a pump with accessories furnished the contractor while in the performance of his contract.

The bond furnished by the contractor, in accordance with the regulations of the State Highway Department, was conditioned that the principal (contractor) “shall in all things well and truly perform all the terms and conditions of the foregoing contract * * * and shall pay when and as due all lawful claims for…
