This is a civil action wherein the plaintiff, a partnership of ten individuals known as Estabrook & Co., a stockbroker age firm, seeks restitution of certain monies paid to the defendant as a result of an alleged mistake during stock transactions between the parties. The matter was heard by a Superior Court justice, sitting without a jury, who entered a judgment for the plaintiff in the amount of $11,705.51. In the defendant’s counterclaim judgment was entered for the plaintiff. The defendant has seasonably appealed to this court.
