Before the Court are defendant’s Amended Motion To Dismiss and for Partial Summary Judgment, plaintiffs’ Motion for Partial Summary Judgment, the parties’ respective oppositions to these motions, and plaintiffs’ reply to defendant’s opposition. 1 Upon consideration of the parties’ submissions and the entire record in this case, the Court grants in part and denies in part defendant’s motion, and denies plaintiffs’ motion.
