MEMORANDUM AND ORDER
JOYNER, District Judge.
This civil action is now before this court pursuant to the Motion of the Plaintiff, Jo*96seph F. Ballato, Jr. to Vacate the Order entered on January 8,1993 pursuant to Local Rule of Civil Procedure 23(b) dismissing the case with prejudice. For the reasons set forth below, the motion is denied.
Briefly stated, the relevant facts underlying the case at bar are as follows. On July 24, 1992, Plaintiff Ballato filed his complaint in this matter by which he sought to recover $100,000 in compensatory and $100,000 in punitive damages from the defendant company…
