OPINION BY

COLVILLE, J.:

¶ 1 This is an appeal from a judgment entered in favor of Appellee David Szy-manski (“Szymanski”) and against Appellant Fletcher-Harlee Corporation (“Appellant”). For the reasons that follow, we vacate the judgment entered below and remand the case for entry of judgment in favor of Appellant.

¶2 The factual and procedural backgrounds underlying this matter can be summarized as follows. Szymanski has been the sole shareholder, director, and officer of several corporations, all but one of which performed concrete contracting work. One such corporation was Delmarva…
