This matter is before the court on appeal from a decision of the Federal Communications Commission (FCC). In a memorandum opinion and order issued November 4, 1977, the FCC rendered final the prior decision of its Review Board that appellants Hudson C. Millar, Jr., and Jerdan Bullard had been guilty of “strike” conduct in connection with a 1966 application for a permit to construct a new standard broadcast station in Sumiton, Alabama.
