The Secretary of Labor (“Secretary”), on behalf of the Mine Safety and Health Administration (“MSHA”), asks us to reverse a November 1995 decision of the Federal Mine Safety and Health Review Commission (“Commission”), affirming rulings by an Administrative Law Judge (“ALJ”) in a case involving citations for alleged tampering with coal dust samples.
