Plaintiffs, Save the Valley, Inc. (“Save the Valley”), Thomas Breitweiser and L. Jae Breitweiser, sue the United States Environmental Protection Agency, et al. (“the EPA”) under the Clean Water Act (“the Act”), originally known as the Federal Water Pollution Control Act, 86 Stat. 816, as amended, 33 U.S.C. § 1251 et seq., and the Federal Mandamus Statute, 28 U.S.C. § 1361.
