Appeal from Second Judicial District Court, Washoe County; C. J. McFadden, Judge. Donald A. Rothrock was convicted of embezzlement, and from the judgment, and an order denying his motion for a new trial, he appeals. Not having been found according to law, the indictment should have been, on defendant’s motion, set aside. The names of many witnesses before the grand jury were not indorsed on the indictment.

The defendant was indicted upon a charge of embezzlement, and, having been convicted at the trial, appeals from the order denying his motion for a new trial, and from the judgment.
The charging part of the indictment is in the following language:
“That said defendant, on the 28th day of May, A. D. 1920, or thereabouts, and before the finding of this indictment, at and within the county of Washoe, State of Nevada, committed thé crime of embezzlement.
