This appeal arises from a special proceeding brought under N.C. Gen. Stat. Secs. 38-1, et seq. (1984), by petitioner, Romer Taylor, to establish the true location of a disputed boundary line between Taylor’s tract of land and an adjoining tract owned by respondent spouses Nellie Taylor Brittain and Ramon A. Brittain. The heart of the controversy is the location of a common corner of the two tracts: Taylor’s northwest corner and the Brittain’s southwest corner.
