This action was brought to recover the sum of $300, with interest from the 15th day of Rovember, 1895, for merchandise, consisting of brick, sold and delivered on or about the last-mentioned date. The sum of $150 was paid on account previous to the commencement of the action, and thereafter and before the defendant’s time to answer had expired, there was paid, under circumstances hereafter detailed, the further sum of $150.
