The indictment charges the defendant with the crime of conspiracy to defraud the Ancient Order of United Workmen. He was from 1920 to 1928 Grand Master of the Order. The evidence relied upon to establish his guilt is wholly circumstantial. Four separate and distinct transactions in which considerable sums of money were obtained from the Order are proven in detail. The alleged connection of the defendant Lowenberg therewith is relied upon by the state to establish the crime charged in the indictment.
