Henderson County Oil Development Company,- a jbint-stoclc association, sued F. E. Cragin dnd H. T. Abies to récover damages for the breach of a written contract, to drill an oil well. The district court of Henderson county wherein the suit was pending convened on Monday, August 20, 1923, and continued in session until October 2, 1923. On August 21 the court made an order setting the case for trial on September 10, 1923. The defendants were represented by Messrs.
