Brannon, President:
James P.. Williams was sentenced to tbe penitentiary upon a conviction of murder in tbe second degree in killing Jobn Meadows, for tbe term of ten years by tbe circuit court of Raleigb County, and be asks tbis Court to reverse that sentence on several grounds.
One of bis objections against the judgment is the refusal of tbe court to bold tbe indictment bad for omitting to state that the grand jury was in attendance upon tbe circuit court of Raleigb County. That is not material in tbe indictment. It does not enter into the charge. Its omission could not prejudice tbe accused.…
