The nature and result of this case have been admirably and concisely stated by the Court of Civil Appeals, as follows:

“Ida M. Green, joined by her husband, brought this suit against the city of Amarillo, to recover damages for personal injuries sustained by her in a collision with a street car operated by the city. The trial court sustained á general exception to plaintiff’s petition.
