This action was brought to recover damages for personal injuries. The cause came on for trial before the court and a jury. At the conclusion of the plaintiff’s evidence, the defendant challenged the sufficiency thereof, and moved for a judgment, which motion was overruled. The defendant offered no testimony, but rested upon the case made by the plaintiff. A verdict in favor of the plaintiff in the sum of $3,750 was returned.
