Stanley S. Labovitz (the “Petitioner”) has filed a pleading entitled “Petition” requesting the sum of $9,675.00 for services as assignee for the benefit of creditors of Colony Press, Inc. (the “Debtor”). The petition presents the Court with a question of first impression in this Circuit concerning the possible conflict of interest involved where a lawyer for a debtor also serves as assignee for the benefit of the debtor’s creditors.
