This case is before the Court on Defendant’s motion to dismiss and motion for judgment upon the administrative record pursuant to Rules of the Court of Federal Claims (“RCFC”) 12(b)(4); and Plaintiffs’ cross-motion for judgment on the administrative record pursuant to RCFC 56.1. Plaintiffs, twelve former United States Air Force officers, allege that certain procedures used by the Air Force in evaluating them for promotion violated 10 U.S.C. §§ 611, 616(c) and 617(c), as well as Department of Defense Directive 1320.9.
