Appeal by Francis R. Hitchcock, from an order of the Supreme Court, made at the Kings County Special Term and entered in the office of the clerk of the county of Kings on the 11th day of February, 1913.
1Per curiam
The relator is the owner of 75 of the 30,000 shares of the capital stock of a transportation corporation. He sought in *329this proceeding a writ of mandamus to inspect the books of the corporation. An order was entered at Special Term denying the application for the writ as a matter of law and not as a matter of discretion. Another proceeding of the same character, between the same parties, was in this court on a ■former appeal. (Matter of Hitchcock, 149 App. Div. 824.)
