By Decision and Order dated January 27, 2010 (“January 27 Order”), the Court denied the motion of defendant Heriberto Rodriguez (“Rodriguez”) for an order to vacate, set aside, or correct his sentence pursuant to 28 U.S.C. Section 2255 (“Section 2255”). (Dkt. No. 80.) Rodriguez filed the instant motion (“Motion”) on October 27, 2015 seeking to vacate and set aside the January 27 Order pursuant to Rule 60(b)(4) of the Federal Rules of Civil Procedure (“Rule 60(b)(4)”).
