¶ 1 California resident M. Stacey Palmer (Palmer) owns real property in Gallatin County, Montana. In 2000 she embarked on a project to develop, improve and subdivide her property. In the fall of 2000 AFM Contracting (AFM) was asked to submit a bid request to perform underground infrastructure work, i.e., installation of water, drain and sewer systems. AFM submitted its bid and Palmer accepted it. AFM completed approximately $169,000.00 worth of work before disputes arose resulting in Palmer evicting them from the job site in June 2001.
