This action was instituted in the district court of Greer county by W. E. Fletcher, hereinafter referred to as plaintiff, against the city of Altus, hereinafter referred to as defendant, for damages to growing crops alleged to be the property of the plaintiff. At the conclusion of all the evidence the trial court ordered all of defendant’s evidence stricken, sustained a demurrer to plaintiff’s evidence, and dismissed the action. Plaintiff has appealed.
