Plaintiff instituted this action to recover damages against defendants for allegedly maliciously and without probable cause, filing in the Superior Court of Los Angeles County a verified petition that she was mentally ill and in need of supervision, care or treatment (Welf. & Inst. Code, §§5040, 5047). That pursuant to said petition a warrant was issued for the apprehension and detention of plaintiff in the psychopathic ward of the Los Angeles General Hospital.
