The complaint in this action is in the usual form for malicious prosecution. Its material allegations were traversed by, the defendants’ answer. The cause was tried by a jury, and a verdict of five thousand dollars was rendered for the plaintiff against the defendants, on which judgment was entered. The defendants thereupon applied for a new trial, which the Court by order granted. From this order the plaintiff* has appealed. The motion for a new trial was based on several distinct grounds.
