Our statute, under which this indictment is found, is as follows—Gen. Stats., ch. 264, sec. 14: “ If the life of any person not in their employment shall be lost by reason of the negligence or carelessness of the proprietors of any railroad, or by the unfitness or gross negligence or carelessness of their servants or agents, in this State, such proprietors shall be fined not exceeding five thousand dollars nor less than five hundred dollars, ‘and one half such fine shall go to the widow and the other half to the children of the deceased.
