MEMORANDUM OPINION
STEPHAN S. MITCHELL, Bankruptcy Judge.
This matter is before the court on cross-motions for summary judgment. The question to be resolved is whether the trustee’s “strong-arm” powers as a hypothetical bonafide purchaser of real property trump (a) a foreclosing mortgage company’s equitable claims to the property; and (b) a lien claimed by the United States of America as the holder of a criminal restitution judgment.
