The defendant was convicted of. the crime of passing a forged instrument. In the information the person defrauded, and upon whom the forged instrument was passed, was alleged to be “the Commercial National Bank, a corporation duly organized and existing under and by virtue of the laws of the United States.” The instrument, as alleged, was a certificate of deposit issued at Salt Lake City, by the “Commercial National Bank,” payable to A.
