STEPHENS, Associate Justice.

This is an appeal from a judgment of the District Court of the United States for the District of Columbia entered upon a verdict directed against the appellant, the plaintiff below, at the close of the evidence. The suit was for permanent total disability benefits claimed to be due under two contracts of war risk term insurance issued to the appellant during military service from April 27, 1918, to June 20, 1919. The contracts had lapsed for non-payment of premiums after discharge, but the insurance was subject to be revived and matured on December 26, 1922, by…
