OPINION
BRYNER, Chief Judge.
Christopher M. Howell was convicted by a jury of first-degree murder. Superior Court Judge Thomas E. Schulz sentenced Howell to sixty-five years with fifteen years suspended. Howell now appeals his conviction, the denial of his motion for judgment of acquittal or new trial, and his sentence. We reverse.
On the night of February 19, 1992, Howell shot and killed George Michael Church. The shooting occurred just outside a trailer Howell shared with his girlfriend, Frankie Peterson, in a trailer park in Thorne Bay, Alaska. As a result of the shooting, Howell was charged…
