MEMORANDUM OPINION AND ORDER
STEPHEN C. ST. JOHN, Bankruptcy Judge.
On July 30, 1999, SunTrust, Kaapland, Inc. and Virginia Stucco Corporation filed an involuntary bankruptcy petition under Chapter 7 of Title 11 of the United States Code against Systems Engineering & Energy Management Associates, Inc. (“SEE-MA”), a Commonwealth of Virginia corporation. This Court entered an order for relief on September 15, 1999. On May 18, 2001, SunTrust Bank (“SunTrust”), through its counsel, filed a Complaint for a Declaratory Judgment, alleging it is entitled to the proceeds of any recovery actions by the…
