This matter is before the Court on appeal from the Order and associated Memorandum Opinion (collectively “the Judgment”) of the United States Bankruptcy Court for the Eastern District of Virginia (“Bankruptcy Court”) entered on August 7, 2008, awarding judgment in favor of Keith L.
