OPINION AND ORDER

DOMINGUEZ, District Judge.

Before the Court is a Motion to Dismiss presented by the defendant, Ms. Belarmina Morales, pursuant to Fed.R.Civ.P. 12(b)(6); (Docket No. 33). Plaintiff, Mr. Guiseppe Pandolfi de Rinaldis (“Pandolfi”), alleged violations of the First, Fifth and Fourteenth Amendments and 42 U.S.C. § 1983 (1995). This Court has jurisdiction pursuant to 28 U.S.C. §§ 1331,1343(3), (4). (Docket No. 1). Additionally, Pandolfi has invoked the Court’s supplemental jurisdiction over his state claims.
