On the 20th clay of November, 1890, the Bhrst National Bank of Sautá Barbara, in the Circuit Court of Ohio county, filed its petition claiming a certain car-load of prunes, attached in the suit of Neill & Ellingliam against *229The Rogers Bros. Produce Company, by virtue of an assignment to it made by the latter company .of the draft drawn for the price of the prunes and the bill of lading.
