This is an action of trespass on the case, commenced and determined in the circuit court of the county of Harrison. The suit was commenced on the 31st day of *159March, 1873, and was brought by the plaintiffs to recover damages from the defendant for negligently killing a' horse and destroying a wagon and contents of plaintiffs on the track of said railroad. •
