By an information filed by the district attorney of San Bernardino County the appellant and his brother, H. B. Hurley, were accused of the crime of manslaughter. Appellant was further accused of failing to stop and render aid after an accident. (Sec. 480, Vehicle Code.) The two cases were tried together, and upon the same evidence, by the court without a jury. H. B. Hurley was found not guilty. R. B. Hurley was found guilty on both charges.
