This appeal is from a judgment of .conviction of the defendant upon a charge of manslaughter which consisted in the killing of one Agnes Johnson on Van Ness Avenue, near its intersection with Sutter Street, in the city and county of San Francisco, shortly after midnight on the morning of October 21, 1922, through the striking of the deceased by the defendant’s automobile while it was being driven by him along said avenue.
