The legality of the proceedings which resulted in the attempted conveyance of the utilities to the plaintiff is challenged upon several grounds. The matter may be considered in a more orderly way by treating the several objections made by those opposed to the sale in the order in which they arose, rather than in following the order *240in which they were presented in the briefs and upon the argument here.
It is urged that the proceedings were improperly initiated by resolution of the council. Sub. (13) (a) of sec. 66.06, Stats., provides:…
